DISCLOSURES TO CALIFORNIA RESIDENTS
BitPay, Inc. has applied for licensure with the California Department of Financial Protection and Innovation (“DFPI”) under California’s Digital Financial Assets Law (“DFAL”). The application is pending, and BitPay, Inc. may continue operating in California while its application is under review by the DFPI. Capitalized terms not defined herein have the meanings given in the Shopper and Donor Terms of Use.
Fees and Charges. BitPay may charge or facilitate fees when you use the Payment Services. A schedule of the fees and charges that may apply is available in the Shopper and Donor Terms of Use. Applicable transaction-specific amounts and exchange rates will be disclosed before you authorize the transaction and in the receipt or transaction record provided to you.
Transaction Records. You have the right to receive a receipt or other evidence of your transaction. At the conclusion of a transaction, BitPay will provide a record that includes BitPay’s name and contact information, including its toll-free telephone number, the transaction type, value, date, precise time, and amount, and the fee charged, including any conversion charge and indirect charge.
Refunds and Transaction Finality. Digital financial asset transfers are generally irreversible after transmission, and BitPay cannot reverse a transfer from your external wallet. A separate refund transaction may be available in limited circumstances, as described in the Shopper and Donor Terms of Use.
Insurance and Legal-Tender Status. No digital financial asset is currently recognized as legal tender by California or the United States. Digital financial assets used with the Payment Services, and related accounts or value balances, are not insured or guaranteed by the Federal Deposit Insurance Corporation, National Credit Union Share Insurance Fund, Securities Investor Protection Corporation, or governmental agency. BitPay maintains private insurance against certain risks of theft or loss, but that insurance is subject to terms, exclusions, deductibles, and limits and may not cover all losses. Upon request, BitPay will provide information about applicable policy terms and the risks.
Unauthorized, Mistaken, or Accidental Transactions. Digital financial asset transactions may be irreversible, and losses resulting from unauthorized, mistaken, or accidental transactions may not be recoverable. If you believe a transaction was unauthorized, mistaken, accidental, or incorrectly processed, contact BitPay as soon as possible at (855) 398-7660 or through https://support.bitpay.com. BitPay will investigate your report and notify you of its resolution and the reasons for that resolution as soon as reasonably practical. Recovery may be available where a loss results from BitPay’s error or as otherwise required by applicable law. Recovery generally will not be available for a transaction BitPay correctly processes in accordance with instructions provided by you or through your external wallet, except as required by applicable law. Transaction Timing and Authorizations. The date or time when a transaction is made or your wallet or account is debited may differ from the date or time when you initiate it. The Payment Services do not provide for recurring or preauthorized digital financial asset payments initiated by BitPay. Each payment or donation is separately initiated by you, and after transmission you generally cannot stop or revoke it.
Changes to Fees, Terms, and Policies. You have the right to at least 14 days’ prior notice of a change to BitPay’s fee schedule, other terms and conditions materially affecting digital financial asset business activity with you, or policies applicable to your use of the Payment Services. The 14-day notice period does not apply to a non-fee change reasonably necessary to address a risk of loss to you or BitPay.

Virtual currency is not legal tender, is not backed by the government, and accounts and value balances are not subject to Federal Deposit Insurance Corporation or Securities Investor Protection Corporation protections.
